Virginia Is For Blow Job Bans
Virginia Attorney General (and busybody pervo) Ken Cuccinelli, who's probably running as the GOP candidate for governor in the state, wants to preserve Virginia's "crimes against nature" law that bans both oral and anal sex. (It makes either a Class 6 felony.)








I'm a Republican. And I plead guilty as an accessory to commission of the crime.
Think about this next time a suspect is accused of swallowing the evidence.

Wouldn't this violate the precedent set by Lawrence v. Texas?

Patrick, not necessarily.
It depends on what grounds Lawrence v. Texas was decided. If in Texas, they criminalized only anal/oral sex between men, then you have equal protection grounds for it violating the Constitution, but if you criminalize oral and anal sex for "everyone", you lose the equal protection argument (because you are not singling gay men out)
Equally odious, I know, but not necessarily unconstitutional.
I haven't looked at Lawrence v. Texas lately, so I am not sure what the grounds were for overturning the Texas law.

I don't know much about Mr. Cuccinelli, but I was already against him since he robo-called my home yesterday.
I agree with RPM, it's still a lot freer here in VA than in DC or MD.

This article seems to be a classic case of jumping to a conclusion without looking at the complete story.
The piece at "Hotair.com" goes into a more detailed analysis. Including the fact that the case involved a 47 year old man and a 17 year old girl. The AG's position was that the activity between consenting adults would not be illegal; but such a statute should still be applicable in sexual abuse of minors.
Whether or not people agree with that, the debate should be based on the total situation,not a strawman argument.

That would make tomorrow her 18 birthday. Now suppose she currently lives in New York

Which is, I've no doubt, exactly what a lot of religious conservatives would ideally love to do.
I'm sure they're a lot more squicked out by gay men doing those things, but I'm equally sure they don't think we straight people should be doing them either.

Luj, it's worth than that. The age of consent in Virginia is effectively 15. Unforced sex between an adult and someone who is 15, 16, or 17 is some kind of misdemeanor, which makes no sense.
Besides that the 47 year old creepo in question didn't even engage in oral sex with the 17 year old. He asked for it (and straight sex) she told him to pound sand and he did. Which makes hima creep, but not a rapist, statutory or otherwise. His charge is soliciting a minor to commit a felony, the felony being sodomy. So asking her for a blowjob is, by Cuccinelli's standard, a worse crime than actually having sex with her. For that matter, it's a worse crime than actually having sex with a high school freshman. Ludicrous. He's depending on the fact that 47 year old creepazoids are unsympathetic in order to get this through. If he does, just wait till some 19 year old ends up a felon when he has a 17 year old boyfriend or girlfriend.
If the concern was really about protecting 17 year olds from adult men (and honestly, this one seemed to do fine, as most do) then they would be howling about how dumb the age of consent laws for all sex acts, including the one that puts the child at risk of pregnancy, are. But they're not. They're trying to make a guy who is a creep into a felon.
