A Hug Now Requires "Affirmative Consent" At UVA -- Or You're Guilty Of Sexual Assault
If you don't explicitly ask for and get permission for your clothed body to touch another person's clothed body in a hug, you could now be accused of "sexual assault" through "sexual contact" at UVA.
It's part of UVA's broad new "sexual assault" policy, explains Hans Bader at Liberty Unyielding:
Because U.Va. lumps together touching, "however slight," and intercourse when it comes to sexual assault, requiring "affirmative" consent for both. ("Affirmative consent" is a misleading term, and does not include many forms of consent that occur in the real world, and are recognized by the courts, as I explain at this link. The new policy further warns that "Relying solely on non-verbal communication before or during sexual activity can lead to misunderstanding and may result in a violation of this Policy."
Here is the essential bit from the new UVA "sexual assault" policy:
A. SEXUAL ASSAULT Sexual Assault consists of (1) Sexual Contact and/or (2) Sexual Intercourse that occurs without (3) Affirmative Consent.(1) Sexual Contact is:
Any intentional sexual touching
However slight
With any object or body part (as described below)
Performed by a person upon another personSexual Contact includes (a) intentional touching of the breasts, buttocks, groin or genitals, whether clothed or unclothed, or intentionally touching another with any of these body parts; and (b) making another touch you or themselves with or on any of these body parts.
(2) Sexual Intercourse is:
Any penetration
However slight
With any object or body part (as described below)
Performed by a person upon another personSexual Intercourse includes (a) vaginal penetration by a penis, object, tongue, or finger; (b) anal penetration by a penis, object, tongue, or finger; and (c) any contact, no matter how slight, between the mouth of one person and the genitalia of another person.
(3) Affirmative Consent is:
Informed (knowing)
Voluntary (freely given)
Active (not passive), meaning that, through the demonstration of clear
words or actions, a person has indicated permission to engage in mutually agreed-upon sexual activity.
This is an awful invasion of students' lives and sex lives. Bader gives an example in another piece of how absurd policies like this play out in real life, within a marriage:
The University of California, on February 25, adopted a policy requiring affirmative consent not just to sex, but to every form of "physical sexual activity" engaged in.I and my wife have been happily married for more than a decade, and like 99.9% of married couples, we do not engage in verbal discussion before engaging in each and every form of sexual activity. Indeed, in the first year of our daughter's life, when she was a very light sleeper (she would wake up if you merely walked into her bedroom and stepped on a creaky part of the bedroom floor), it would have been unthinkable for us to engage in any kind of "out loud" discussion in our bedroom, which is right next to hers (the walls in our house are very thin, and you can hear sounds from one room in the next room). We certainly did not verbally discuss then whether to have sex. Having sex quietly when you are a parent is a sign that you are considerate of sleeping family members, and have a healthy marriage, not of sexual abuse.
Also, most sexual contact you have with a person you're dating or in a relationship with, you don't want to ask for. "May I kiss you now?" "May I use my penis to penetrate your vagina now?" I mean, if you have to ask that way, never the fuck mind, because I'm going to read a book.

The way thing are going, I expect, that any time now, I'm going to be greeted by a blank-stared drone who tells me, "Welcome to Costco, I love you. . . "

In many ways, that's more cost efficient. For the university. They get to charge the same amount, but once the lectures are recorded and made the best they can be, the faculty member in question never actually has to teach the course again. And a student who is only infrequently on campus (if at all) doesn't require the same resources that one who is on campus frequently.
Also, for a motivated student, they can probably work out a class in a couple of weeks if all the lectures are available immediately.
I'm left wondering: if someone bumps into me and doesn't immediately apologize, have I been sexually assaulted? In addition to the whole "all men are rapists" and "gain power over others without earning it", this gives cover to the whole #YesAllWomen hashtag fuckery.
On the other hand, this is a perfect opportunity to, as InstaPundit says, punch back twice as hard and as I say make the bureaucracy live by the rules they impose on us and given that women are more likely to be uninvited huggers, put the Title IX coordinator on your speed dial gentlemen and report every unwanted and uninvited hug. #YesAllMen Insist they follow thru.
If enough women get mangled in the process, they'll rewrite the code. If they don't follow thru, or do it inconsistently, you have a ready-made lawsuit and free money coming your way.
You may have to go all Natan Sharansky on them, but do it. It isn't like college campuses are actual Soviet gulags.

I think it is about more than protecting schools from lawsuits. There's a general paternalism at work here, an idea of adults as post-pubescent lifelong children. There's a need for more government -- The Big Adult -- when you have a bunch of children running around. The people who try to squeeze it into every area of our lives don't get that it can someday be used to trip them up or even jail them, too.

These people are insane. No one ever in the history of the world acted like they now require students to act. "may I kiss you" yeah, right. not ever going to happen ever. Is this how the proponents of these rules act? I doubt it. Furthermore, even if you got such consent verbally, you (the boy) have no way to prove that you did. The girl can still say she didn't or say she was scared to say no or she changed her mind. The advantage for justice with the old definition of rape was that the woman was usually beat the hell up, cut, and sexually injured so it is clear she did not give permission.

It ended when I hugged a person well-known to me that had transitioned into a butch lesbian and I became concerned she/he might punch me when I released from the very awkward light social hug. Until it happens to you or your sister, daughter, family member, you have no idea of what sexually assaulted victims go through at this school. It's criminal. Dont worry, your sweet boys are safe there...regardless of what they are doing and however brutal. UVA will make sure they are not held responsible. They haven't taken their sexual assault policies seriously for decades so there's no worries these policies will change a thing. By the way, for all of you accusing rape victims of being liars and falsifying reports, no one would put themselves through the horror that they go through, to tell such a lie. The Rolling Stone article did such a disservice for all the real rape victims there that they could have chosen for the article.
