Tell A Tasteless Joke On Social Media; Get Suspended From College For Almost Two Years
Remember "Animal House"?
Remember when telling tasteless jokes was kind of what college was about? At least, in part?
Well, from campus free speech defenders theFIRE.org, a six-word joke has gotten a student suspended from Colorado College. Katie Barrows reports:
Colorado College has suspended and banned a student from campus for nearly two years in response to a comment intended as a joke on the anonymous social media application Yik Yak.In November 2015, Thaddeus Pryor sent an anonymous reply to the comment "#blackwomenmatter" on Yik Yak. Pryor's response read, "They matter, they're just not hot." On November 20, Colorado College found that Pryor's post violated its "Abusive Behavior" and "Disruption of College Activities" policies and suspended him from the college until August 28, 2017. In the meantime, the college has banned Pryor from setting foot on campus and has forbidden him from taking classes at other institutions for academic credit. Pryor has appealed his suspension.
In a letter sent on November 25, 2015, the Foundation for Individual Rights in Education (FIRE) urged Colorado College, a private institution, to honor its moral and contractual obligation to keep the promises of freedom of expression that it makes to students. Colorado College's Student Guide, The Pathfinder, provides that "all members of the college community have such basic rights as freedom of speech...."
"Colorado College's disciplinary action toward Pryor--a 21 month suspension--for posting what was intended to be a joke on social media completely contradicts the school's promises of freedom of speech," said FIRE Senior Program Officer Ari Cohn. "The college's punitive and heavy-handed overreaction to Pryor's social media post will have a chilling effect on campus discourse."
...Just last month, Colorado College wrote a letter to the campus community proclaiming that its commitment to diversity is intertwined with its commitment to dialogue. FIRE again urges Colorado College to uphold its promises of freedom of speech on campus.
"Colorado College may not claim to respect freedom of expression while throwing a student out for two years for making a six-word joke," said Cohn.

How can they do this? I would just say "Fuck you" to the college and take whatever courses I want. They cannot stop a person from enrolling at another school, nor can they stop the accreditation process conferred by another school.

My thoughts exactly Patrick.
Wish someone w/big bucks would start sticking it to these guys w/law suits, publicity, and no settlements just a public admission (on and off campus) of wrong-doing.

Yeah, I noticed the bit Patrick cited as well. It seems to me that once they kicked Thaddeus Pryor off campus, Colorado College's control over him would be ended, and so much the better for both of them. I wonder if any other college in Colorado would have the guts to announce publicly that they're admitting the guy, just to make Colorado College look ridiculous?

This is why FIRE is taking his case.
It's horrible and unbelievable that they would say he cannot take classes elsewhere.
Amy Alkon at December 8, 2015 5:22 AM
How did the school identify him if it was an "anonymous" post on YikYak?
mark at December 8, 2015 5:35 AM
I suppose Colorado College could say, "If you take classes at another school, we will not accept you back." But to forbid him from doing so? They don't have the authority.
Patrick at December 8, 2015 5:53 AM
SO THIS IS BAD:
"Pryor's response read, "They matter, they're just not hot."
BUT THIS IS NOT:
Black Lives Matter protesters harass students studying in Dartmouth University library

Bob in Texas at December 8, 2015 6:10 AM
Patrick, I guess what they meant by that is that if he takes classes elsewhere in the meantime, they won't permit the credits to be transferred back. But yeah. My response would be, "What makes you think I intend to ever enroll here again?"
And Mark hit on the elephant in the room. Yik Yak will respond to subpoena, but other than that, it guards the anonymity of its posters religiously, from what I have heard. How did the school find out it was him? Was he stupid enough to brag about it to his friends? Or is there a snitch inside Yik Yak?
Cousin Dave at December 8, 2015 6:33 AM
They probably whined to YikYak that one of their users had made a credible threat, and YikYak rolled him under the bus.
If I'm YikYak, I go back at Colorado College and ask them publicly if they made a false claim to gain personally identifiable information.
YikYak is only pseudo anonymous. You can read their page, but the long and short of it is:
So...who submitted the request? This will be fun, as YikYak will be subpoenaed by FIRE to determine who submitted the LEO request and the contents of that request.

Patrick, I'm going to guess they also won't release his transcripts, so that he may not transfer to another school. Generally that is only done when you still owe the school money.
Also, am I bad that for the most part, I agree with him? for the most part, black women do nothing for me.
I R A Darth Aggie at December 8, 2015 7:25 AM
No, you're not a bad person. You like what you like and our tastes are not conscious choices. You might have a preference for fairer skin, less full lips, smaller butts, etc. All of that is perfectly reasonable and your right to have.
Am I a bad person because I like chocolate more than vanilla?
But I will say this. I see a day coming, in the not too distant future (next Sunday, A.D. -- never mind), when a black woman who might be interested in you can sue you for that statement and legally force you to have a date with her. Emotional distress caused by your "racism," whatever.
And, who knows? Will legally-compelled marriages be next? Just imagine! Being sued and forced to enter relationships because of our individual tastes?
Patrick at December 8, 2015 8:03 AM
Patrick, stop that.
1. You're scaring me.
2. Don't give the totalitarians among us ideas. They have enough already.
KTHXBAI

A few points
As others have pointed out they have no right withhold his transcripts, or forbid his transfer.
And the fall out from Yik Yak should be interesting
But as to the REASON they expelled him, the code of conduct.
Colleges for years, when sued by students, have claimed that the code of conduct is not a contract that they as colleges can be forced to abide by. And they win with that argument
So why has no expelled student ever sued and made the argument that colleges have no right to make students abide by the codes either?
And Patrick, under many college yes mean yes, and domestic violence rules, refusing to have sex and refusing to display affection to the approval of a female is sexual asault against said female
lujlp at December 8, 2015 10:09 AM
As a longtime member of a university faculty, I am astonished by this lunacy. I fear we will see more and more such outlandish responses to politically incorrect behavior. Colleges and universities want to claim what they see as the moral high ground so that they are not targets of student protests. "If we crucify this white boy, the students will not occupy the president's office."
Colorado College should have ignored this matter entirely. If students complained, the college could justify that (non)response. I do not see any reasonable way to justify their actual response.
DrPinWV at December 8, 2015 1:56 PM
The joke wasn't even offensive.
Here's your ticket to heaven:
Organize some kind of network system using college athletes to beat the holy crap out of college administrators who do things like this. You can't reason with them. They think that the stuff they do is correct. And when words are insufficient to straighten someone out, that only leaves violence.
Do you remember how much better the world was when everyone knew that if they mouthed off, they might be buying a knuckle sandwich? It's time to make the world better.
Alan at December 8, 2015 8:08 PM
Probably get more results Alan if the alumni could be shamed about supporting a college w/such employees. Money always talks loudest (unless you are a barbarian horde at the door).
Bob in Texas at December 9, 2015 4:36 AM
Let's see now. Saying that black women aren't hot is abusive. Saying they are hot. . . wouldn't that be sexual harassment or something?
