America Has Become A Giant Nursery School: Pottymouth Charged With Hate Crime Against Cops
New Orleans pussies, uh, police arrested a man this week and charged him with a hate crime after he shouted slurs at officers, reports Emily Lane in the Times Picayune:
It appears to be the first time Louisiana's so-called "blue lives matter" provision has been used to charge someone with a hate crime involving police officers, according to the Anti-defamation League.
Yes, pass a law and somebody with the power to arrest somebody's ass will be quick to use it.
Raul Delatoba, 34, was booked Monday (Sept. 5) on charges of simple criminal damage to property, disturbing the peace and a felony-level hate crime, his arrest warrant says. During his arrest, but after he had broken the window, Delatoba is accused of using sexist and racial slurs against police officers, the document shows.According to arrest documents, Delatoba was drunk and banging on a window at the Royal Sonesta Hotel, 300 Bourbon St. around 5:15 a.m. Monday, when a witness who heard the banging told him to stop. Delatoba's warrant says he yelled at the witness, "calling him a n-----."
That witness, a security guard who works at a nearby building's mezzanine, along with a security supervisor for the Royal Sonesta, flagged down two Louisiana State Troopers who then escorted Delatoba to NOPD's 8th District station, the warrant states. Once at the station, the warrant states, Delatoba began to verbally "attack members of the New Orleans Police Dept." The warrant states Delatoba called one female officer a "dumb a-- c---" and another officer a "dumb a-- n-----."
The warrant states Sgt. S. Jackson instructed NOPD Officer Williams Knowles to charge Delatoba with a hate crime in addition to damaging property and disturbing the peace. "The hate crime charge stems from Delatoba's attack on individuals based on their race, sex, and occupation," the warrant states.
Oh, boo frigging hoo.
As for the elected panderer, uh, legislator who sponsored the legislation...
The sponsor of the "blue lives matter" legislation, State Rep. Lance Harris, R-Alexandria, said he pushed for the provision to give district attorneys "an extra tool in (their) toolbox" and offer additional protection for first responders. The change to the law received wide, bipartisan support in the legislature.
If a little blue language is too much for fragile you, you should be a knitting instructor or babysit stuffed animals. You should not be a cop.
Beyond the rather obvious First Amendment protection, there's case law that suggests that this law is unconstitooooty-nal. Now I'm no lawyer (first clue is "The Advice Goddess" above), but I know my profanity cases. Cohen v. California -- the "Fuck the Draft" case -- seems to be a reference here.
Once again, it occurs to me that elected otters would be an improvement over elected legislators.
P.S. I fucking love words, including the word fuck -- along with the civil liberties that we're still supposed to have in this country.

Not my fight but I've seen several news reports of cops being accused of being racists because of their personal comments on social media. Is this a First Amendment issue as well?
Since our President and our youth seeing no problem with a hate group (#BLM) calling for the death of cops I'm not sure where the next step is.
Charging an out of control person with multiple different crimes of an 'out of control' nature is just another example of "piling on" by the LEO establishment.
It used to be that grownups were in charge but now everyone is going all PC, I'm a victim, and hate crimey. What's good for the goose is good for the gander.

'cause that's how we want the policing mechanism of our society to work, burying citizens in paperwork and criminal charges. Innocent until proven guilty? Not really. Innocent until exhausted.

Not only accused, but also being reprimanded by their superiors.
I would say, tho, in this case they should have put him in the lockup with the father rapers. Go ahead, drop a few nbombs in lockup. See how quickly the "dumb a-- c---" and "dumb a-- n-----" come running to save you from the beating you'll be receiving...

Yes, it is a First Amendment issue. A cop acting as private citizen has the same right as anyone else to express his convictions, conclusions or feelz. However, if that expression reflects on his employer then he may be disciplined by the department. That is a matter of contract not free speech.
That said, last I checked, a cop cannot be arrested and charged with a felony for calling someone a "dumb a-- c---".

Yeah, another tool. DA's don't need any more freaking tools. They've already got enough tools to build the Taj Mahal. There's hardly a person charged these days that doesn't get hit with at least six or seven different charges for the same act. And some of them give way too much leeway to charge for things that ought not to be crimes, or just civil violations at worst.
Bob mentions "piling on" of charges. Note that the UCMJ -- which a lot of civilians consider draconian -- specifically prohibits piling on. In some ways, you are far more likely to get a fair trial in a military courtroom.
