"Nobody knows . . . the Wubbels I seen!"
Remember Jeff Payne, the police detective and phlebotomist who, in July 2017, wanted to do a blood draw on an unconscious semi-driver, but was prevented by hospital policy (agreed to by both the hospital and the police department) which didn't allow the police to take blood unless the patient was under arrest, there was a warrant or if the patient was consented.
None of those criteria were met, so the hospital, through nurse (and former skiing Olympiad) Alex Wubbels told Payne that he could not be allowed to take the blood drawing.
Payne insisted that implied consent laws allowed him to take the blood, but that is incorrect. Implied consent only applies if the driver is under arrest. Since the semi-driver was not under arrest, implied consent doesn't apply.
Payne, frustrated, lunged for Wubbels, insisting that she was under arrest. Probably because he, being a clueless neanderthal, didn't like being told by a woman (especially an attractive woman) that he wouldn't be allowed to do what he wanted.
"NO WUMMUN TELL ME WUT TOO DOO!"
The backlash was swift and the Police Chief Brown issued a lengthy letter to Payne, explaining the myriad of reasons he was fired.
(Lieutenant James Tracy, who ordered the arrest, was demoted two ranks.)
But now, it seems that Jeff Payne is back, suing his former employer and the city for wrongful termination, demanding 1.5 million in damages and his old job back.
I should confident that he won't win, but I don't like the willingness of departments to settle and I'm hoping in this case, they don't. Payne is an ass. (Supposedly, the police department nicknamed him "Payne in the ass.")

Related to my previous post, this is a lengthy (but interesting) read. It is Chief Brown's redacted dismissal letter to Payne.
Interesting points that I gleaned from this:
1)Wubbels had been instructed by four separate departments above her -- Risk Management, House Privacy Officer, House Manager and her supervisor -- not to allow the blood draw.
This is especially ironic because Payne's complaint is that the police department should have accepted responsibility for the fallout and instead made him "the fall guy."
Isn't that precisely what he did to Wubbels? She was the messenger, not the one making the decision, but he manhandles her?
2) The Logan Police Department did not at all consider the blood draw exigent, contrary to Payne's claim of "exigent circumstances," and simply instructed Payne that if he couldn't get the blood draw, then submit a request for medical records.
3) Payne did not advise Lt. Tracy of this alternative route requested by the Logan Police Department. Tracy could have advised Payne to submit the request form, but he was not aware that option existed.
4) Chief Brown also notes that the arrest itself, even if it were for valid reasons, which it was not, was conducted with an apalling lack of professionalism. At no point was Wubbels given the opportunity to comply. No "Please place your hands behind your back." He went straight for the manhandle.

What really surprises me this year is cops actually getting fired. Previously they could simply pop people like zits or chokehold them until the stress caused a cardiac arrest and the only thing in court would rule is that the police officers behaved accordingly to their training.
I mean, the only time they would be out of a job is when they were caught boning a minor.
Now lets' hope that the unionized VA -as in Veterans Affairs but this also works for the state of Virginia- workers are next on the line of firings.

The one thing that Payne said that I agree with is that if it had not been recorded, he'd still have a job. And probably Lt. Tracy would not have been demoted.
It either takes incredible guts or incredible stupidity for Payne to act like he did nothing wrong.
