A Horny Teen Isn't The Same As A Sex Offender
A guy was convicted of "lewd and lascivious conduct" over sexual activity with his own girlfriend when he was 18 and she was 15. Is this guy the same as some perv who hangs out drooling over children outside a school? Of course not. But, the law doesn't know the difference. And it should be changed to differentiate.
Chris Hagan has now been ordered to move himself and his wife and children from Barre, VT, because it's an "'exclusion zone' set up as part of a safety ordinance banned him from living in the apartment he rented," according to an AP story at Boston.com. The ACLU is suing on his behalf.

This is the kind of bullshit that makes the sex offender list completely useless. As a parent, I want to know if there are child molesters living close by. I couldn't care less about guys who had underage consentual sex with their girlfriends - they are not a threat to me! More parents need to know that they can not trust the information on these lists. Maybe that will cause enough outrage to change these stupid laws.

A lot of times it seems like the ACLU does things that annoy me...this is one of the times that I smile and say "they're not so bad after all".

I check the sex offender list for my area pretty regularly... but here, it's fairly detailed. It tells you what the crime was, when it took place, and what the age of the victim was. So, I know that the little grandpa-looking guy a few blocks away is actually a pedophile, the 25-year old dude in the apartment complex a half mile away had sex with his 16-year-old girlfriend when he was 19, but his neighbor is a rapist. I appreciate how detailed the lists are.

In Washington State he would also be considered a domestic abuser because he “raped” his girlfriend. I know a guy who when he 14 had sex with his 12 year old girl friend – slightly more than 2 years younger. It did not get reported until he was 18 which meant he could be tried as an adult. He pled guilty and was put on probation. He will be on the sexual predator list until he is 35 and on the domestic abuser list forever.
He has to be very careful with his leases. If he ever is without a home, he is considered a "high risk" offender which means that he can never find a place to live because no one would rent to a "high risk" offender. I rented a house to him after checking the details with his probation officer. He was a nice guy and good tenant who got screwed to "protect the children."

If the 15-year-old was indeed Mr. Hagan's girlfriend at the time, then I agree -- turn the ACLU loose on 'em. However, neither the AP article nor the iFeminist summary made that clear to me, though I could have missed something. If she wasn't his girlfriend, then I think we'd need to know more about the "lewd and lascivious conduct" before making a judgement.
By the way, the Hagan story wasn't even close to being the scariest-looking item on the iFeminist site. Check out the link to the Mothers Act story. Sounds pretty draconian, if it's really like they say it is.

Some teens here foolishly decided to make a porn video. It was the 16 yr old girl's idea to make money, and her 18 yr old boyfriend "performed" with her, while another 18 yr old friend held the camera. A 13 yr old boy walked in the room briefly. I'm not sure of all the charges, but the paper initially said they were each being charged as "sex offenders" because it involved a tape with intent to distribute.
I'm not advocating what they did, but it's the kind of hair-brained idea teenagers come up with. I know a few of them - including the boy who held the camera - and they're good kids. I hate to see their lives ruined by having to register as sex offenders. We need another category to address cases like this, as well as "sexting" cases. The sex offender lists just aren't appropriate.

Sorry, Curtis, but they can't change the rules in hindsight. If you're not an adult when you allegedly commit a crime you can't be charged as one when you're tried years later. Only the laws in play when you commit the crime come into play for conviction. I could be wrong, but I"m guessing no way that 14 year old was tried as an adult because the "crime" wasn't reported until he was 18.

Lujlp, that is dirty pool. That comment has nothing to do with this. And, fyi, I understand both 16 yr old girls on the film were arrested and charged as sex offenders too. Perhaps you'll have to reconsider how biased the courts are. Seems to me they are being equally ridiculous here.

I don't know about other states, but here in texas the exact offense-along with the vics age and the perps age when the crime occurred, is easily available right next to the pic on the sex offender website. Seems pretty basic info to have.

Momof3, your kids are little, so you probably haven't yet experienced the poor judgment and impulsiveness that occasionally overcomes a teenager. They can be make mistakes and still be good kids.
The girl was a runaway, and she was afraid to go home. She'd been staying at one of the kid's houses for two weeks. She came up with the idea to make money so she wouldn't have to go back to her (possibly abusive?) home. Really dumb, but the other kids were apparently just trying to help her. I don't think these are a bunch of budding Bob Gucciones.

With their penises. Even if the cameraman's didn't get on film, it was definitely the one making the decisions.
I have to side with Momof3: "good" kids don't make porn videos.
Of course it's inaccurate to label them pedophiles. For consensual underage sexual activity it would be better to have a misdemeanor level penalty combined with some kind of education (not that it'll help, but you have to try) to teach these kids to avoid dangerous behavior.
Better yet, society should remake itself in such a way that people acquire the ability to make informed decisions about sex as soon as their bodies are capable of it, instead of two decades later.
