But then came his warning that "the founders never gave that one branch of government the power to make a law."
So, if the courts can't make law and Dred Scott is "the law of the land," who does he think decidedDred Scott? Congress?

Actually, the Dred Scott decision basically said that slaves are not citizens and have no legal standing to bring a lawsuit in US Federal court, and so they dismissed Scott v. Sanford. They also decided that the Missouri Compromise of 1821 was unconstitutional, and that the Federal government could not simply free slaves that were brought into a free state or territory without violating the 5th amendment.
This is wikipedia's page on it. I would agree with Justices Curtis and McLean that once the suit was dismissed on standing grounds, the rest was moot. If anything, I would say majority opinion would be an example of an activist court.

Actually, there were free blacks born in non-slave states who were citizens of those states and thus citizens of the United States. They had the right vote and all.
The sad thing for Mr. Scott was that had he gone to the Louisiana courts when he was called back from Minnesota by his master, they would have likely emancipated him and his family, as they had precedent to do just that.

I think it is because they are both somewhat behind in the polls and were trying to grab more attention and more votes. They don't seem to realize that such "religious" talk turns off the rest of us and they lose more votes than they gain; or maybe they just don't care.
