Teacher Could Face Charges For The Crime Of Being A Crime Victim
Say someone robs your house and makes off with a bunch of money. They buzz right on over to the liquor store, buy a bunch, get skunked, and then run somebody over. Kill them.
Naturally, we should charge you, try you, and throw you in jail, right?
Well, that's the tenor of things at a high school where a teacher left her phone unattended.
Elizabeth Nolan Brown writes at Reason:
A South Carolina high-school teacher may be charged with contributing to the delinquency of a minor after a student stole her cellphone and distributed partially nude photos from it around the school. Administrators say she should have password-protected the phone.The male student grabbed the phone from Union County Career and Technology Center teacher Leigh Ann Arthur's desk while she was making required hall-monitoring rounds between classes last week. After discovering the phone was unlocked, he went through Arthur's photos, eventually finding some sexually oriented shots that Arthur says she took for her husband. By the time she returned to the classroom, the student was texting the photos to other students. According to Arthur, he told her: "Your day of reckoning is coming."
One might think that the student would at least face disciplinary action from the school, if not criminal charges of some sort. But thus far, the school has not moved to hold the 16-year-old student accountable at all. Arthur, however, is another story. After teaching in Union County for 13 years, she resigned when district officials gave her the choice to do so immediately or start the firing process.
Interim superintendent David Eubanks said that Arthur might also be charged with contributing to the delinquency of a minor. "I think we have a right to privacy, but when we take inappropriate information or pictures, we had best make sure it remains private," he told The State.
I do think she was kind of an idiot. But what's more idiotic is "zero tolerance" policies expanded to the teaching staff.
Oh, and my advice on the subject, from "Good Manners for Nice People Who Sometimes Say F*ck":
Consider what you have to lose before you let someone--even someone you love, in a relationship you are sure will never end--turn a video camera on your naked patootie. Remember, times change; videos get mysteriously "lost." Your willingness to appear doggy style on video should be directly disproportionate to how much you like your job as an elementary-school principal.
This isn't to say it should be this way; but obviously, that's how it is.
And how lovely that the student isn't being held accountable at all. That'll teach him -- well, that his actions don't have much in the way of consequences.

Yes, I agree that the teacher is an idiot. Yes, I agree that the student should be punished.
However, the biggest idiot in this case is the brain-dead that actually wrote the article you're quoting.
Yeah, naked selfies are obviously every bit as useful to have -- even essential -- as televisions and cars. I've owned televisions and cars in my life and will continue to do so. One thing I have never owned, however, is a naked selfie.

This is a contractual issue.
If her contract allows her to be terminated for poor judgment, this incident, certainly qualifies.
In a perfect world, being an idiot could get you fired quickly from a teaching position.
Glad she resigned. It was the smart thing to do.
Leaving an unsecured cell phone full of naked pictures on a desk is the same as leaving a folder or wallet full of prints of naked pictures on a desk.

Just when you think school systems have run out of ways to invert offenders and victims, they come up with a new one. Yeah, leaving nudies on your unlocked phone, not smart. But having them live forever on the Internet is punishment enough. Contract or no contract, she'd probably have to resign for that reason alone, because the students would never let up on it. Filing charges is just piling on.

Yeah, "day of reckoning" work both ways, son. You're 16, you need to start acting like an actual man and learn about honor. Don't worry, the thrashing I'm about to lay on you will teach many things.
I'd give her a thrashing, too, for a) leaving your phone unattended, and b) not putting a lock code on your phone. A different sort of thrashing, but one none the less.

Three points: first I agree with Isab about it being like leaving a folder of Picts on desk. 2 can you effectively work as a teacher where it is likely naked pictures of you are probably seen by a high % of your class? That alone would cause many to resign. 3. We are hearing only her side of the story where she looks like an idiot. His side may be completely different with evidence being he said/ she said.

Not sure how to feel about that. I mean, there would be suddenly a serious shortage of actual teachers, and thus salary's would increase, and possibly the nonsense[*] that would keep me out of a high school classroom as a teacher would be waived.
[*] specifically, a teaching certificate. I'll note that as a gradual student, I taught undergraduates without such certification. Oh, and some of those undergraduates? education majors specializing in science education. I still savor the delicious irony of that.

Does he deny redistributing something that wasn't his?
Does he deny violating US Code Title 17, Section 501?
Does he deny violating Title 16, Article 17 of the South Carolina Code of Laws?
Avoiding self-incrimination is a perfectly legitimate reason to remain silent.

I have no sympathy for this idiot. Shouldn't she be on the sex-offender registry for bringing porn to a school? Yes, I think she should be. And if you don't agree, then how would you feel if she brought a folder or a wallet full of naked pictures to a school and left them unattended on her desk, since Isab says the situations are identical?
And the student who stole her phone and sent her pics out to his fellow students should also be on the sex offender registry, for distributing porn to minors.
Unlike Elizabeth Nolan "Braindead" Brown, who wrote this article, I don't understand why anyone needs to have naked selfies to the extent that someone needs their cars or televisions.
It seems some of the teacher's students have started an online petition to bring her back. Not going to happen, but nice thought. I signed it, just so I can leave a comment telling them how hopeless their efforts are.
Your intention should be to go back to English class and learn not to write run-on sentences. And why do you not want this student to be "absolutely berated"? He absolutely should be.

When it seems obvious someone should be charge and they aren't, I start thinking there's a side we aren't hearing.

@Patrick: WTF? If you left your wallet at your desk, and someone came and took it, that's theft. If you kept a racy pic of your wife in there (which some of us have been known to do), you might just feel like you have an expectation of privacy on the contents of your wallet.
Now maybe leaving your wallet lying on your desk is not a clever thing to do, but it can happen accidentally. Anyhow, it's your damned desk.
That's exactly what happened here, except it was her phone, not her wallet. Personal items on a person's desk are personal. Taking them is stealing. This is not a difficult concept.
What we have here is racial. It's the typical behavior you can expect of a black kid wanting to embarrass his white teacher. Most likely her "day of reckoning" was his way of getting back at her for giving him the poor grades that he deserves.
The kid belongs in juvenile, the teacher belongs back at her job, and the administrator belongs in the unemployment line.

Poor judgment is NOT a criminal offense!
Now, some times poor judgment may lead to criminal behavior; but poor judgment isn't a crime in itself.
She used poor judgment to leave the phone where someone could be tempted to steal; and more poor judgment leaving it unlocked.
The kid used poor judgment to steal the phone; and more poor judgment to share the photos.
Both the teacher's actions and the student's actions showed poor judgment; but, only the student's should be considered criminal.

The only way I could possibly leave my wallet at my desk, especially in front of a class full of high-school students, is accidentally. My wallet and my phone stay on my person. Especially if I worked in a high school.
And as others have pointed out, not having her password protected, especially with the contents of her phone and the fact that she's a high school teacher, is just plain dumb.
I didn't happen to notice that the student is black. But that's irrelevant anyway.

I find it highly improbable that a 16-year-old used the phrase, "day of reckoning."
That said, if her story is true, she needs to file charges against him. Actual charges with the police, not school charges.
It's not that she needs the selfies (like she might need a tv or a car), but that it's her right to have them stored in a device that is her private property; and the student committed burglary by going through her phone and sending them out.
Eubanks is an idiot, too, but he is right about not having them in existence if you don't want them distributed (accidentally or intentionally).
We park our cars in the garage to avoid having them vandalized, damaged, or burglarized. Nonetheless, it's her right to have the pictures and expect that if out of sight in her phone, the student will not break into her phone and steal them. It's not like they were on her Facebook page.
This isn't analogous to her leaving her car outside; her car was in the garage and the student broke into the garage and stole the car.

I'm not. If the student was euphoric over the trouble he was causing (as he likely was), and has heard the phrase before (any Christian knows what the Day of Reckoning is), he might very well have used that phrase. I've seen the phrase used in X-Men comics.

Yes, he should not have done what he did. He did a terrible thing, I agree. But this is starting to sound like the whinging of feminists who shriek that we're "blaming the victim" if we tell female college students to keep an eye on their drinks. No one has a right to slip drugs into your drink to take advantage of you while incapacitated. But the fact of the matter is, some assholes out there do things like this. You can either keep an eye on your drink, or complain about how horribly you were violated when you are raped.
Same deal with this teacher. She can protect her cellphone or she can complain that no one had the right to take her cellphone when her nude selfies leak out.
But she didn't lock the garage and left the keys in the ignition.

Personally, I think that student should be looking at prison time for distributing porn to minors and lifetime on the sex offender registry.

Patrick, I agree that what she did was foolish. I'm assuming that the phone was on her desk and not in it, thus sparing the student an additional charge of breaking and entering.
In this case, the student's actions were the greater evil. He not only violated someone's privacy, but violated a standard of decency as well. And quite possibly committed a crime. Being 16 is no excuse for his behavior. That she left the phone out and accessible or failed to password protect is no excuse for his behavior. He made the conscious choice to break into her phone and then to steal her personal photos.
Yes, in this case, the superintendent is blaming the victim. His attitude is that she was foolish (and slutty), so her humiliation is deserved and she should be fired for it.
It's not like she left the nuclear launch codes in an unlocked briefcase on the steps of the Russian embassy or used a personal e-mail server for classified e-mail. She had an expectation of a certain amount of privacy in this situation. She left her personal information on her personal phone and a student stole the phone and the information. That he gave it back (with a smirk) makes it no less a theft.
What if he had used her banking app to transfer money to his and his friends' accounts? Or purchased something for himself with her Amazon app? Or sent malicious texts from her phone to her husband's? Would the superintendent still insist on firing her and "investigating" the student?

I'm guessing the race from the behavior. In black youth culture, it's cool to disrespect and shame teachers, especially white teachers. Getting hold of a nude pic of a female teacher must be the ultimate thrill.

Hate to say it, but it has just about come to that. The craziness we endured in the 80's and 90,'s over small cheap audio recording devices, has revisited us over cell phone cameras.
