CA's Prop 65 Has Turned Into Abusive Lawsuit Bonanza For Lawyers
Prop 65 says there has to be a warning label on a product if one of numerous common chemicals (800 of them) is in use in the product, and lawyers have gone after Chuck Firth, inventor of the Durascoop kitty litter picker-upper.

"Failure to label has created a cottage industry of lawsuits ... and the lawsuit over this may put Chuck Firth out of business."Under Prop 65, the plastic handle on Chuck's Durascoop needed a warning label. So, lawyers filed lawsuits that may have the impact of forcing Chuck to shut his doors, taking the popular Durascoop off the market for good.
UPDATE: More on the idiocy of Prop 65. (That nickel in your pocket -- as in, that five cent piece -- why doesn't it have a warning label on it?)
I've seen those ridiculous labels all over everything in California. Every single building you step into has a sign at the door. For the Durascoop guy, I'm afraid the answer is simple: don't market in California. And I wonder how many other businesses will eventually reach that same conclusion. To give one example, I spend a fair amount of time looking over catalogs and ads for performance car parts, and a lot of them say "Not for sale or use in California".

I bought an air mattress pump, and the electrical cord on it, just the electrical cord, contained a proposition 65 warning.
And I was left wondering, was there no other electrical cable they could use? Do I want to touch this thing? How come none of my other two hundred devices with electrical cord don't need prop 65 warnings?
I can't speak to Chuck Firth's product, or how it is made, or the costs, or the costs of re-enginering, but again I wonder, how is it I have all these other tools with handles and none of them need a proposition 65 warning?
I have no doubt lawyers abuse the process. Part of the reform of that is to attack the lawyers directly when frivolous suits are filed or perhaps here, when they don't give their target a chance to correct his product without penalty.
