" In May, the New York City Commission on Human Rights declared that refusing to refer to someone by their preferred gender pronoun (from "him and her" to "ze, xe, hir," and many others) is "harassment" and punishable by "civil penalties up to $125,000 for violations, and up to $250,000 for violations that are the result of willful, wanton, or malicious conduct." Lawfareblog starts off quite reasonable. But they certainly end on a whopper N.
"Say what you will about the FBI, but it's surely been independent."
I'm afraid you won't find many people who aren't partisan hacks who will agree with that. FBI agents with financial ties to the individual they were investigating, the unusual way the investigation proceeded, and even the way Comey ended things all point to the FBI's lack of independence.

You keep using that word. I do not think it means what you think it means. Also, do you happen to have 6 fingers on your right hand?

Ben, I agree that sentence was a ridiculous statement but the rest of the post was a worthwhile read.
I'll agree with you on that N. It is certainly a more accurate account of what the FBI is doing than I've seen most places. It is just too bad they had to end on such a terrible line.

"Say what you will about the FBI, but it's surely been independent."
basically the way I see it, Comey's got his balls caught in the proverbial wringer, and he's deperately searching for a way out.
Something is going on. Either some lower level agents threatened to blab, or he knows they are going to anyway in the next week.
I can think of a few different possibilities. One is that Huma was passing classified info on to foreign interests like perhaps the Muslim brotherhood, or there is a detailed email exchange about how to delete all the damaging emails and wipe the server or there is info in there covering Hillary's serious health issues and alcoholism. Maybe all three.
The fact that this info was ferreted out by agents working another investigation leads to my legal speculation that Comey lost control of the tight security around the original email investigation when this info was discovered independently by the agents working the Weiner sexting case.
Since these agents arent covered by all those non disclosure agrements that everyone signed, he really had no choice but to reopen the investigation to try and rope in all those Weiner emails back under his control. It may be to late to do that.
Some enterpising FBI agent already made a copy of it, and stored it in a secure location to cover his own damn ass.
I came for the snark, I stayed for the unexpected poetry.

"basically the way I see it, Comey's got his balls caught in the proverbial wringer, and he's deperately searching for a way out."
That's the part that gets me. What did Comey think was going to happen? Did he really believe that Hillary's gang of technologically incompetent weenies had everything covered?
Also, regarding the FBI's handling of the case: let's not forget that nearly all of the principals, other than Hillary herself, were granted unconditional immunity. That never happens. Immunity is always conditioned upon giving a full and complete testimony and answering all questions. Always. And there is plenty of precedent that says that if the immunized person still refuses to testify, immunity can be revoked. Hillary's people didn't get immunity. They got pardons by another name. I wonder if Obama will make that official on his last night in office.
