It Doesn't Really Get More Obscene
Ryan Zempel writes at the Institute For Legal Reform about a ridiculous lawsuit that has not a shred of humor about it:
After a fight with her boyfriend, a teenage girl sent him several text messages, including ones that said "Good bye ... My last words ..." and "If I won. I would have you. And I wouldn't crash my car." She then proceeded to drive her car into oncoming traffic at 85 mph, killing a 35-year-old pregnant woman and the woman's 13-year-old son.The teenage girl, on the other hand, survived - and is now suing the estate of the woman she killed and the construction company which built the overpass where the collision occurred. Yes, you read that correctly: a girl driving 85 mph into oncoming traffic with the intent of causing a fatal accident is suing the family of her victims. According to her lawsuit, she's seeking unspecified damages since she's dealing with permanent injuries, mental pain and suffering, a loss of income, and past, present and future medical expenses.
While this experience was doubtless very traumatic for her, it's nothing compared to the husband of her victims, who not only has to deal with the tragedy of losing his family but is now listed in her lawsuit as the representative of his wife's estate.







This should be somehow criminal. The girl and her lawyer have crossed a line into criminal frivolity. I hope counter-suits are planned.

I think she should repeat the experiment (without anyone else involved), until she gets it right.
Yeah, I'm an evil bitch. I don't care if someone wants to kill him/herself. Been there, done that. Failed in the attempt and crawled back to sanity.

Ok, if I'm the grieving guy and got handed this, I'll bet I could file a bigger lawsuit claiming the loss of my family, my sanity, and the fucking car. I hope he lands on her like two and a half tons of scrap iron.

This is why "Loser Pays" must be made law if every state. No other developed country lets people get away with nuisance law suits without having to pay.

If that were my daughter she wouldn't have to worry about repeating the experiment.. She would for sure end up wishing she had succeeded the first time though.

Here we go:
"The girl and her father filed the lawsuit on July 15 contending Thompson, four months pregnant, caused the crash."
They don't say how old the girl is, so I'm assuming she's a minor. That her father is filing this suit with her makes me want to punch both of them.

She is beyond the pale of compassion or consideration. Put a handgun to her selfish head, tell her "This is how you should have done it." Then pull the trigger on this worthless piece of trash. Use the second round in the chamber on her worthless father.

Why isn't she in prison for murder? She planned the wreck, carried out the plan, and killed people. Seems open and shut to me, but then I'm not a prosecutor. if this little bitch wins money, I swear I will kill her myself.

The girl is apparently being charged with deliberate Homicide, so she isn't getting off scott free. BUT, her dad is still a fucking twit. It must be someone else's fault that your kid is fucked up right? Because you can't just admit that she needs counceling and a swift dose of justice or something right?

The article Amy links to has a link to a source story that gives a bit more detail. The "girl" probably is a is a minor, given that her name is never revealed in the story. But when you are engaged in adult acts like driving a car, you should be held to adult responsibilities.
She is charged with two counts of "deliberate homicide". In her defense, she and her father hired a "self-employed engineer" to argue at a preliminary hearing that there's no actual evidence that she was the one on the wrong side of the highway.
They probably think that filing this lawsuit helps them with their defense somehow.
A story from two weeks later (http://www.kpax.com/news/winter-pleads-not-guilty/) gives her name and states that she is being tried as an adult. If convicted, she faces life in prison.

Because judges view advocates as "my tribe, right or wrong". If they didn't, the lawyer would be facing disbarment and a year in the slammer for contempt.

The girl is a minor-there's no way this lawsuit is of her own volition. There has to be parents behind this, or an unscrupulous lawyer, or a clever defense attorney who thinks that this is a way to muddy the waters.
But still-this girl needs to be locked up. If there was ever a definition of danger to society, she is it.

Forget loser pays, this is a good example why lawyers should be sueable or frankly given the death penalty for bringing such lawsuits.
