Jesse Ventura's TSA Suit Tossed
I'm heartened that he brought suit, but disheartened by the results. Via InfoWars:
Former Minnesota Governor Jesse Ventura said he would now refer to the country of his birth as the "Fascist States of America" after a judge dismissed his case challenging airport pat downs, adding that his only recourse now would be to run for President."Ventura made his comments outside the federal courthouse in St. Paul, where in January he sued to challenge the Transportation Security Administration's (TSA) airport security procedures," reports the Minneapolis Star Tribune. "The suit was thrown out because Congress set up the law so that all such challenges must be brought directly in Circuit Courts of Appeals, wrote U.S. District Judge Susan Richard Nelson."
"They said they don't have jurisdiction," Ventura told reporters. "Well my question is if the federal courts don't have jurisdiction over a constitutional question then who the hell does?"
A further detail that Ventura revealed on the Alex Jones Show which has not been picked up by mainstream media reports is the fact that Ventura's lawyer was told he could not even look at the ruling due to "national security" concerns.
By the way, I met and had a lot of fun verbally sparring with Ventura when producers of his TV show flew me to Minneapolis to test to be his co-host on his planned TV show.

Can Ventura not do this? Just take his case directly to the court of appeals? Or is this a catch-22 situation, because the Courts of Appeals cannot hear original cases?

Sounds like the way you get your gun rights restored: go to the ATF guys and apply for reinstatement. It's the only way.
However, Congress simply "de-funded" the program, so now you can not get your rights restored.
That's some catch, that Catch-22.

It's easy to understand the former governor's reaction to his search and his court ruling. The patdowns really can be that offensive, as the site hostess knows firsthand. A court setback like the one he had, where the fourth amendment precedent he cites seems so obvious, is hard to understand.
Hopefully he'll realize that this is a fight worth fighting and he'll find a way to keep going. If he wants to refile in the DC Circuit Court of Appeals, where EPIC has had some success, I'm sure a lot of Americans would welcome his efforts.
As for running for President, we'd all be better served if presidential candidates paid more attention to this issue. He'll have to start acting like a politician and be more careful about what he says. His remarks about spending more time in Mexico are easy to misinterpret.

The Patriot Act is 10 years old and in general, what has a single goddamned lawyer done to stop it?
If it takes a former SEAL, wrestler, governor to stand up to this shit, well good on him, and shame on us.

Jesse Ventura is not and never has been a Navy SEAL.
He was a member of the UDTs - Underwater Demolition Team. The UDTs were merged with the SEALs several years after Ventura was discharged.
