Planning can be a very short period of time, like taking a gun out of your glove box, to blow away a car full of kids with loud music, rather than a guy robbing a liquor store.
They were never a physical threat to him.
Like the guy in the movie theatre that killed the jerk with the cell phone, this is murder.

Not saying it isnt murder Isab. In fact I think the death penalty should be expanded to some sections of second degree murder.
I just think it prosecutorial creep to claim that 0.05 seconds is a long enough amount of time to qualify as premeditation.
